durante palestra proferida no CENTUR no dia 19.12.22 em evento promovido pela Funda\u00e7\u00e3o Par\u00e1Paz, cujo tema foi o Fluxo de Atendimento da Rede de Prote\u00e7\u00e3o no Combate \u00e0 Viol\u00eancia e \u00e0 Explora\u00e7\u00e3o Sexual. Conhe\u00e7a os passos sugeridos para a constru\u00e7\u00e3o do fluxo de atendimento conforme a Lei 13.431\/2017.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Conhecer o p\u00fablico alvo beneficiado com o fluxo;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Conhecer os requisitos para a defini\u00e7\u00e3o do fluxo;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Conhecer a estrutura e o funcionamento dos programas, servi\u00e7os e institui\u00e7\u00f5es;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Conhecer as atribui\u00e7\u00f5es previstas no Estatuto da Crian\u00e7a e do Adolescente, Lei 13.431\/2017 e Decreto n\u00ba 9603\/2018;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Construir a proposta de fluxo;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Reunir para apresentar a proposta de fluxo;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Ajustar a proposta, caso necess\u00e1rio;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Implementar o fluxo de atendimento;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Monitorar, avaliar e ajustar o fluxo de atendimento.<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><b>  P\u00daBLICO ALVO BENEFICIADO COM O FLUXO:<\/b><\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Crian\u00e7a ou adolescente v\u00edtima ou testemunha de viol\u00eancia e, facultativamente, pessoas entre 18 e 21 anos de idade v\u00edtima ou testemunha de viol\u00eancia (art. 1\u00ba e 3\u00ba, \u00a7 \u00fanico da Lei 13.431\/2017);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">A defini\u00e7\u00e3o de crian\u00e7a e adolescente est\u00e1 no art. 2\u00ba do ECA;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Formas de viol\u00eancia: f\u00edsica, psicol\u00f3gica, sexual e institucional (art. 4\u00ba da Lei 13.431\/2017);<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><b>REQUISITOS PARA A DEFINI\u00c7\u00c3O DO FLUXO (Art. 9\u00ba, II do Decreto 9.603\/2018):<\/b><\/span><\/p><ul><li aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Os atendimentos \u00e0 crian\u00e7a ou ao adolescente ser\u00e3o feitos de maneira articulada;<\/span><\/li><\/ul><ul><li aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">A superposi\u00e7\u00e3o de tarefas ser\u00e1 evitada;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">A coopera\u00e7\u00e3o entre os \u00f3rg\u00e3os, os servi\u00e7os, os programas e os equipamentos p\u00fablicos ser\u00e1 priorizada;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Os mecanismos de compartilhamento das informa\u00e7\u00f5es ser\u00e3o estabelecidos;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">O papel de cada inst\u00e2ncia ou servi\u00e7o e o profissional de refer\u00eancia que o supervisionar\u00e1 ser\u00e1 definido;<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><b>CONHECENDO A ESTRUTURA E O FUNCIONAMENTO DOS CONSELHOS TUTELARES<\/b><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">Para exemplificar esta etapa da constru\u00e7\u00e3o do fluxo, utilizaremos o Conselho Tutelar como refer\u00eancia. Entretanto, os itens abaixo sugeridos servem como direcionamento para se conhecer a estrutura e o funcionamento de todas as institui\u00e7\u00f5es que estiverem envolvidas no atendimento em quest\u00e3o ao coletar as seguintes informa\u00e7\u00f5es:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Hor\u00e1rio de funcionamento;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Escala de plant\u00e3o;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Contatos: telefone, e-mail, whatsapp;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Endere\u00e7o;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Acesso \u00e0 internet;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Meios para recebimento de den\u00fancias: SIPIA CT, Disque 100, e-mail, telefone, of\u00edcio;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Capacita\u00e7\u00e3o para realiza\u00e7\u00e3o da escuta especializada (art. 27 do Decreto 9.603\/2018);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Mecanismos para compartilhamento de informa\u00e7\u00f5es preservando o sigilo (art. 9\u00ba, \u00a72\u00ba do Decreto 9.603\/2018);<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><b>ESTATUTO DA CRIAN\u00c7A E DO ADOLESCENTE<\/b><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">Art. 136. S\u00e3o atribui\u00e7\u00f5es do Conselho Tutelar:<\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">I &#8211; atender as crian\u00e7as e adolescentes nas hip\u00f3teses previstas nos <\/span><b>arts. 98<\/b><span style=\"font-weight: 400;\"> (<\/span><span style=\"font-weight: 400;\">As medidas de prote\u00e7\u00e3o \u00e0 crian\u00e7a e ao adolescente s\u00e3o aplic\u00e1veis sempre que os direitos reconhecidos nesta Lei forem amea\u00e7ados ou violados)<\/span><span style=\"font-weight: 400;\"> e <\/span><b>105<\/b><span style=\"font-weight: 400;\"> (<\/span><span style=\"font-weight: 400;\">Ao ato infracional praticado por crian\u00e7a corresponder\u00e3o as medidas previstas no art. 101)<\/span><span style=\"font-weight: 400;\">, aplicando as medidas previstas no art. 101, I a VII;<\/span><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">II &#8211; atender e aconselhar os pais ou respons\u00e1vel, aplicando as medidas previstas no art. 129, I a VII;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">III &#8211; promover a execu\u00e7\u00e3o de suas decis\u00f5es, podendo para tanto:<\/span><\/p><ol><li><span style=\"font-weight: 400; color: #000000;\">a) requisitar servi\u00e7os p\u00fablicos nas \u00e1reas de sa\u00fade, educa\u00e7\u00e3o, servi\u00e7o social, previd\u00eancia, trabalho e seguran\u00e7a;<\/span><\/li><li><span style=\"font-weight: 400; color: #000000;\">b) representar junto \u00e0 autoridade judici\u00e1ria nos casos de descumprimento injustificado de suas delibera\u00e7\u00f5es.<\/span><\/li><\/ol><p><span style=\"font-weight: 400; color: #000000;\">IV &#8211; encaminhar ao Minist\u00e9rio P\u00fablico not\u00edcia de fato que constitua infra\u00e7\u00e3o administrativa ou penal contra os direitos da crian\u00e7a ou adolescente;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">V &#8211; encaminhar \u00e0 autoridade judici\u00e1ria os casos de sua compet\u00eancia;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">VI &#8211; providenciar a medida estabelecida pela autoridade judici\u00e1ria, dentre as previstas no art. 101, de I a VI, para o adolescente autor de ato infracional;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">VII &#8211; expedir notifica\u00e7\u00f5es;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">VIII &#8211; requisitar certid\u00f5es de nascimento e de \u00f3bito de crian\u00e7a ou adolescente quando necess\u00e1rio;<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">IX &#8211; assessorar o Poder Executivo local na elabora\u00e7\u00e3o da proposta or\u00e7ament\u00e1ria para planos e programas de atendimento dos direitos da crian\u00e7a e do adolescente;<\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">X &#8211; representar, em nome da pessoa e da fam\u00edlia, contra a viola\u00e7\u00e3o dos direitos previstos no\u00a0<\/span><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Constituicao\/Constituicao.htm#art220%C2%A73ii\"><span style=\"font-weight: 400;\">art. 220, \u00a7 3\u00ba, inciso II, da Constitui\u00e7\u00e3o Federal\u00a0<\/span><\/a><span style=\"font-weight: 400;\">;<\/span><\/span><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">XI &#8211; representar ao Minist\u00e9rio P\u00fablico para efeito das a\u00e7\u00f5es de perda ou suspens\u00e3o do poder familiar, ap\u00f3s esgotadas as possibilidades de manuten\u00e7\u00e3o da crian\u00e7a ou do adolescente junto \u00e0 fam\u00edlia natural.<span style=\"color: #0000ff;\">\u00a0<\/span><\/span><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2007-2010\/2009\/Lei\/L12010.htm#art2\"><span style=\"font-weight: 400;\">(Reda\u00e7\u00e3o dada pela Lei n\u00ba 12.010, de 2009)\u00a0<\/span><\/a><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2007-2010\/2009\/Lei\/L12010.htm#art7\"><span style=\"font-weight: 400;\">Vig\u00eancia<\/span><\/a><\/span><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">XII &#8211; promover e incentivar, na comunidade e nos grupos profissionais, a\u00e7\u00f5es de divulga\u00e7\u00e3o e treinamento para o reconhecimento de sintomas de maus-tratos em crian\u00e7as e adolescentes.\u00a0<\/span><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2011-2014\/2014\/Lei\/L13046.htm\"><span style=\"font-weight: 400;\">(Inclu\u00eddo pela Lei n\u00ba 13.046, de 2014)<\/span><\/a><\/span><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico.\u00a0 Se, no exerc\u00edcio de suas atribui\u00e7\u00f5es, o Conselho Tutelar entender necess\u00e1rio o afastamento do conv\u00edvio familiar, comunicar\u00e1 incontinenti o fato ao Minist\u00e9rio P\u00fablico, prestando-lhe informa\u00e7\u00f5es sobre os motivos de tal entendimento e as provid\u00eancias tomadas para a orienta\u00e7\u00e3o, o apoio e a promo\u00e7\u00e3o social da fam\u00edlia.\u00a0<\/span><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2007-2010\/2009\/Lei\/L12010.htm#art2\"><span style=\"font-weight: 400;\">(Inclu\u00eddo pela Lei n\u00ba 12.010, de 2009)\u00a0<\/span><\/a><a style=\"color: #0000ff;\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_Ato2007-2010\/2009\/Lei\/L12010.htm#art7\"><span style=\"font-weight: 400;\">Vig\u00eancia<\/span><\/a><\/span><\/span><\/p><p><span style=\"color: #000000;\"><b>LEI 13.431\/2017<\/b><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Art. 13. Qualquer pessoa que tenha conhecimento ou presencie a\u00e7\u00e3o ou omiss\u00e3o, praticada em local p\u00fablico ou privado, que constitua viol\u00eancia contra crian\u00e7a ou adolescente tem o dever de comunicar o fato imediatamente ao servi\u00e7o de recebimento e monitoramento de den\u00fancias, ao <\/span><b>conselho tutelar<\/b><span style=\"font-weight: 400;\"> ou \u00e0 autoridade policial, os quais, por sua vez, cientificar\u00e3o imediatamente o Minist\u00e9rio P\u00fablico.<\/span><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">Art. 15. A Uni\u00e3o, os Estados, o Distrito Federal e os Munic\u00edpios poder\u00e3o criar servi\u00e7os de atendimento, de ouvidoria ou de resposta, pelos meios de comunica\u00e7\u00e3o dispon\u00edveis, integrados \u00e0s redes de prote\u00e7\u00e3o, para receber den\u00fancias de viola\u00e7\u00f5es de direitos de crian\u00e7as e adolescentes.<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">Par\u00e1grafo \u00fanico. As den\u00fancias recebidas ser\u00e3o encaminhadas:<\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">I &#8211; \u00e0 autoridade policial do local dos fatos, para apura\u00e7\u00e3o;<\/span><\/p><p><span style=\"color: #000000;\"><b>II &#8211; ao conselho tutelar, para aplica\u00e7\u00e3o de medidas de prote\u00e7\u00e3o (artigo 101 do ECA); e<\/b><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">III &#8211; ao Minist\u00e9rio P\u00fablico, nos casos que forem de sua atribui\u00e7\u00e3o espec\u00edfica.<\/span><\/p><p>\u00a0<\/p><p><span style=\"color: #000000;\"><b>DECRETO 9.603\/2018<\/b><\/span><\/p><p><span style=\"font-weight: 400; color: #000000;\">Art. 9\u00ba Os \u00f3rg\u00e3os, os servi\u00e7os, os programas e os equipamentos p\u00fablicos trabalhar\u00e3o de forma integrada e coordenada, garantidos os cuidados necess\u00e1rios e a prote\u00e7\u00e3o das crian\u00e7as e dos adolescentes v\u00edtimas ou testemunhas de viol\u00eancia, os quais dever\u00e3o, no prazo de cento e oitenta dias, contado da data de publica\u00e7\u00e3o deste Decreto:<\/span><\/p><ul><li><span style=\"font-weight: 400; color: #000000;\"> 1\u00ba O atendimento intersetorial poder\u00e1 conter os seguintes procedimentos:<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">IV &#8211; comunica\u00e7\u00e3o ao <\/span><span style=\"font-weight: 400;\">Conselho Tutelar<\/span><span style=\"font-weight: 400;\">;<\/span><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">VIII &#8211; aplica\u00e7\u00e3o de medida de prote\u00e7\u00e3o pelo <\/span><span style=\"font-weight: 400;\">Conselho Tutelar<\/span><span style=\"font-weight: 400;\">, caso necess\u00e1rio.<\/span><\/span><\/p><p><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Art. 14.
